Furthermore, data on Americans collected incidentally while surveilling foreign targets is also permissible.
Perhaps most critically, agencies can legally purchase sensitive commercial data bundles that include detailed location histories and internet browsing records. This practice, often called the “data broker” market, has been embraced by numerous agencies, from Immigration and Customs Enforcement to the FBI. These datasets can provide authorities with a depth of personal insight typically requiring a warrant if sought directly, yet they are acquired through a simple commercial transaction.
This reality underscores a major gap in privacy protection. A substantial volume of information the government can gather on individuals falls outside the scope of Fourth Amendment protections or specific statutes. Even more concerning, there are few meaningful legal constraints on how the government can subsequently use that aggregated data, especially when analyzed by powerful AI systems capable of finding patterns and making inferences on an unprecedented scale. The law, as it stands, may be insufficient to address the novel challenges posed by artificial intelligence in the realm of domestic security.
