The state classifies these power plants as “mobile” because they sit on flatbed trailers, which exempts them from air pollution rules for one year. The NAACP has filed a lawsuit on behalf of local residents, arguing that the unchecked emissions are worsening air quality in an already polluted community. This week, the group requested a court injunction against xAI.

The central dispute revolves around whether the turbines are truly mobile. The Southern Environmental Law Center, representing the NAACP, contends that the turbines violate federal law. Under federal guidelines, power plants mounted on trailers can still be considered stationary sources and therefore subject to air pollution regulations. Mississippi’s current interpretation, however, allows xAI to bypass those requirements.

So far, xAI has secured permits for only 15 of its turbines. A press release from the Greater Memphis Chamber of Commerce previously stated that “about half” of the 35 turbines operational in May 2025 would remain on site. Yet the company has continued to add more. According to a local news report, xAI is now running 46 turbines at the facility.
